Yes, as of July 1, 2025. Under SB 1454 (signed by Governor Newsom in 2024), California Business and Professions Code section 7524 now mandates that all agreements entered into by a California licensed private investigator be in writing, with the requirement effective July 1, 2025.
The written agreement must include:
- Approximate start and completion dates of the work.
- A description of the scope of the investigation or services to be provided.
- All labor, services, and materials to be provided for the scope of work (including employees working under the PI license, and any contractors or outside services).
- An explanation of fees agreed upon, including a breakdown of how fees are assessed.
- Whether a written report will be provided and the method of delivery.
- Any other matters agreed upon by the parties.
A few practical points worth noting:
- Any amendment, addendum, or modification to the initial agreement must also be in writing, and must describe the changes to scope, dates, method of delivery, and fees. Email communications can serve as notification and acceptance of continuing work as long as the required details are included.
- If a client refuses to sign the contract (even if the licensee offered one), the licensee is still in violation and their license is subject to disciplinary action under BPC 7561.1 and/or 7563. So no signature, no work, period.
- A written report to the client is not required unless both parties agree and document it in the services agreement; if the client does not want one, that should be noted in the contract.
- For unknown or yet-to-be-identified expenses, parties can address those under the “any other matters agreed upon” provision, but anything that changes later still needs to be in writing.
